The petitioner seeks regular bail in a case registered under Sections 364A/34 of the Indian Penal Code. Ram Ratan Rai, the father of the victim boy Bipin Rai, informed that three persons were chasing his son for kidnapping. The informant went there but his son was found traceless. The informant suspected the hands of Bhagnarayan Chaudhary (the petitioner) and Sudhir Rai as some dispute had arisen on account of payment of tuition fees. Learned counsel for the petitioner submits that the victim was never kidnapped. On account of payment of tuition fees, this case has been lodged. The supervising authority found that while Bhaganarayan Chaudhary was imparting tuition, he developed affairs with the daughter of the informant and, that is

The victim boy disclosed the name of Sudhir Rai but did not disclose the name of the petitioner. Sudhir Rai has already been enlarged on bail vide order passed in Cr. Misc. No. 28491/2014. It appears that the informant suspected the petitioner in kidnapping of his son but it has come that the petitioner had developed affairs with the daughter of the informant and, that is why, this case is lodged. Sudhir Rai has already been enlarged on bail. The petitioner is in jail since 11.09.2014. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar-IV, J.M. 1st Class, Begusarai in Bachhawara P.S.
