The petitioner is languishing in custody since 29.10.2014 in a case registered for the offences punishable under Sections 341, 447, 323, 379, 376/511, 504 and 506 of the Indian Penal Code.

It is alleged that the petitioner abused the informant and on protest being made assaulted the informant with slaps and pushed her on the ground and thereafter he wanted to establish forceful physical relationship with the informant. He also snatched silver chain from the neck of the informant. It is submitted by learned counsel for the petitioner that the informant received no injury nor the informant

Patna High Court Cr.Misc. No.3599 of 2015 (02) dt.28-01-2015 2/2 has been examined by any doctor nor her statement under Section 164 Cr.P.C. has been recorded. Petitioner is next door neighbour of the informant and for the petty dispute the accusation has been levelled.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur in connection with Piar (Hatha O.P.) P.S. Case No. 111 of 2014.
