Mr. Lakshmi Kant Sharma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 14-07-2021 Heard the parties in virtual Court proceeding. The petitioners are languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioners are driver and cleaner of the vehicle from which liquor was recovered. They have stated on oath in supplementary affidavit that they have got no criminal antecedent. They are in custody since 01.10.2020. Investigation of the case is already complete.

Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the

Patna High Court CR. MISC. No.14386 of 2021(3) dt.14-07-2021 2/2 like amount each to the satisfaction of the learned Court-below where the case is pending in connection with C-I Case No.102 of 2020 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
