Mr. Anil Prasad Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 06-02-2025 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 74, 76, 352 and 3(5) of the BNS-2023. As per allegation in the FIR, the informant alleged that on 25th October, 2024 the petitioner entered into scuffle with her father with respect to returning the money owed by the petitioner to her father. It is further alleged that the petitioner kicked the informant twice or thrice in her private part and also by fist on her chest and pulled her hair and assaulted on the head with a pipe.

Learned counsel for the petitioner submits that

He next submits that both parties have amicably settled the dispute between the parties which is evident from Annexure-P/2 of this petition and all offences are bailable except Sections 74 and 76 of the BNS.

Learned APP for the State opposes the prayer for anticipatory bail of the petitioner.

In view of the aforesaid facts and circumstances as also the fact that both parties have compromised the case, so I am inclined to grant anticipatory bail to the petitioner. Accordingly, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Darbhanga in connection with Bahadurpur P.S. Case No. 449 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
