The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B and 34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.

As per the prosecution case, the daughter of the informant was married to the son of the petitioner in the year 2016. She was tortured for non-fulfillment of demand of dowry and ultimately burnt to death with kerosene oil. It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. The petitioner has been falsely implicated in the case because of his relationship of being the father-in-law of the deceased. The allegations are general and omnibus in nature and

Patna High Court CR. MISC. No.14215 of 2021(5) dt.04-10-2021 2/2 the petitioner is in custody since 23.4.2020. The petitioner has no criminal antecedent and chargesheet has been submitted in the case. It is finally submitted that the husband of the deceased is in custody.

The prayer for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the petitioner who is the father-in-law of the deceased having remained in custody for over 1 year 5 months, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.332 of 2021(arising out of Naubatpur P.S. Case no.82 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge V, Danapur, District Patna.
