The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 406, 341, 323, 506, 34 of IPC.

The prosecution case, in brief, is that the marriage of the petitioner was settled with the daughter of the informant Surendra Prasad Sinha and motor-cycle and other presentation were also given but later on the petitioner has refused to marry and also assaulted the informant and others.

Learned counsel for the petitioner submits that the marriage of the petitioner was settled with the daughter of the informant. The daughter of the informant refused to marry when

Patna High Court Cr.Misc. No.5945 of 2015 (2) dt.12-02-2015 2/3 she came to know that the petitioner is a Class-IV employee in the Agriculture Department and his permanent house is in a rural area in the district of Khagaria, whereas, the informant belongs to urban area.

It is further submitted that the petitioner and his mother are still ready to perform the marriage of the informant's daughter with the petitioner. The petitioner has no criminal antecedent and has been in custody since 15.11.2014. Chargesheet has already been submitted and there is no chance of tampering with the evidence.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar Bharti, Judicial Magistrate 1st Class, Patna/court concerned in Budha Colony P. S. Case No. 322 of 2014 with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each
