The petitioner seeks bail in a case instituted under Sections 363, 365, 379 of the Indian Penal Code but later on Sections 364, 302, 379, 411 and 120B/34 of the Indian Penal Code have been added.

The prosecution story in brief, is that one tempo driver namely Md. Bablu @ Md. Rahim took the Safari vehicle of the informant on fare but till 09.03.2016 at 3.00 P.M. neither phone is connecting from the driver nor there is any trace of driver or vehicle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.10.2016. The charge sheet has

Patna High Court Cr.Misc. No.55404 of 2016 (4) dt.22-03-2017 2/2 been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. There is no eyewitness to the alleged occurrence nor there is any substantive evidence to suggest his implication in the present case. The name of the petitioner has come on the basis of confessional statement of co-accused. The other co-accused has been granted bail vide Cr. Misc. No.26377 of 2016.

On behalf of the state it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Uda Kishunganj, Madhepura in connection with Bihariganj P.S. Case No. 32 of 2016.
