The petitioner seeks regular bail in connection with Banka (Barahat) P.S.case no.583 of 2019 registered for offences punishable under Sections 399/402 of the Indian Penal Code. Police on information that some persons have assembled for committing dacoity , raided the place of the occurrence, two persons were arrested along with the motorcycle and five persons succeeded in fleeing away including the petitioner. No paper of the motorcycle was produced. It further appears that the petitioner is accused in four other cases. Submission of the learned counsel for the petitioner is that he has been arrested only on confessional statement of the co-accused, there is no recovery . He is in custody since 9.10.2019. Charge sheet has been submitted as such there is no chance of tampering with the evidence.

No.3506 of 2020(2) dt.31-01-2020 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Banka (Barahat) P.S.case No.583 of 2019 with further condition that he has to appear before the police of his local area for a period of six months so that the police may watch his conduct, otherwise his bail bond shall be cancelled. Let a copy of this order be communicated to the S.P. Banka for the needful.

With the above direction, this application is allowed.
