Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Special Case No. 6962 of 2021, arising ouit of Agamkuan P.S. Case No. 1019 of 2021 registered for offence punishable under section 30 (a), 32 (3), 41 (1) of the Bihar Prohibition and Excise Act, 2018.

As per allegation, 7173 litres of wine was recovered from a truck, which was driven by the petitioner. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.5277 of 2022(2) dt.24-05-2022 2/2 that the petitioner is truck driver and he has no concern with the consignment loaded in the truck. He is under custody since 28.10.2021.

Considering the period of incarceration, the petitioner above-named is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 6962 of 2021, arising out of Agamkuan P.S. Case No. 1019 of 2021.

With these observations/directions, this regular bail petition is disposed of.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
