====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 23-06-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.

2. Petitioner apprehends his arrest in connection with Laheriasarai P.S. Case No. 304 of 2022, registered for the offences punishable u/s 363, 366A/34 of the Indian Penal Code and Section 8 and 12 of POCSO Act, pending in the court of learned Exclusive Special Judge (POCSO Act), Darbhanga.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application with a liberty to surrender before the learned Court below within four weeks and seek regular bail.

4. Permission is granted with the aforesaid liberty to the

Patna High Court CR. MISC. No.2001 of 2025(4) dt.23-06-2025 2/2 petitioner to approach the learned Court below for grant of regular bail which would be considered on its merits preferably on the same day in accordance with law without being prejudiced by this order and the learned Court below would also take into consideration that the name of the petitioner does not feature at all in the statement of the victim recorded under 164 Cr.P.C.

5. Accordingly, the application stands dismissed as withdrawn.
