JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29.04.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code. Petitioner is said to have given single farsa blow causing head injury to the informant. Preliminary injury report i.e. annexure 4 goes to show that one injury was found on right scalp of the informant. The concerned doctor kept the opinion reserved regarding the nature of the aforesaid injury but the I.O, without obtaining complete injury report, submitted charge sheet. This court directed the Superintendent of Police, Patna to ensure of sending complete injury report but all went in vain. Neither any reply of Superintendent of Police, Patna nor injury report has been received to this court.

Petitioner is in jail custody since 4.12.2015 and, therefore, I

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur in Naubatpur P.S. Case no. 694/2015.
