Petitioner is accused in connection with Motihari Town P.S. Case No. 154 of 2015 registered under Sections 413 and 414/34 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the petitioner is not named in the F.I.R., rather the name of the petitioner and one Bittu has been disclosed by co-accused Ekraj showing the involvement of the petitioner in committing theft of the seized articles. Further, submission is that while petitioner is accused in Motihari Town P.S. Case No. 152 of 2015, but he is on bail in that case and in the present case, petitioner is in custody

Patna High Court Cr.Misc. No.9142 of 2016 (2) dt.28-03-2016 2/2 since 18.09.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran at Motihari in connection with Motihari Town P.S. Case No. 154 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner. (Rajendra Kumar Mishra, J) Shail/- U T
