2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 118, 109, 126 and 3(5) of the B.N.S.
3. The case of the prosecution is that the petitioner has given a knife blow in the stomach of Chandan Kumar, son of the informant.
4. Learned counsel for the petitioner has submitted that in this case the name of the petitioner has been implicated due to land dispute. It has also been submitted that there is only one knife blow and there is no repetition. From perusal of the injury report it also transpires that Doctor has found knofe embedded in the abdomen and abdominal content came out. Regarding
Patna High Court CR. MISC. No.4909 of 2025(3) dt.04-04-2025 2/2 nature of injury, opinion reserved. The petitioner is a man of clean antecedent and he is in judicial custody since 18.07.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the fact that there is only one knife blow and the petitioner is a man of clean antecedent, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bairiya P.S. Case No. 239 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of Chief Judicial Magistrate, Bettiah, West Champaran.
