====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-02-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 354, 307, 379, 504, 506/34 of the Indian Penal Code.
3. The prosecution case, in brief, is that on 29.03.2024, all the FIR named accused persons including the petitioners entered the house of the informant and started abusing her and on protest, petitioner no.1 gave iron rod blow on the head of the informant. When the informant's husband and informant's sons intervened in rescue, they too were assaulted by the petitioners
Patna High Court CR. MISC. No.4068 of 2025(2) dt.07-02-2025 2/3 and co-accused persons by lathi and danda. In the meantime, petitioner no.3 committed theft of gold wedding chain of the informant and petitioner no.2 took away Rs. 1,000/- from the pocket of the informant's son.
4. It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and have committed no offence. No such occurrence as alleged has ever taken place. Petitioners have falsely been implicated in this case due to ulterior motive. The allegation levelled against the petitioners is totally false and based on concocted facts. Nothing specific has been attributed against them. There is admitted land dispute between the parties. Both sides have filed cases against each other. The injuries sustained by the informant's side were found simple in nature. Similarly situated co-accused have been enlarged on bail by this court vide order dated 12.12.2024 passed in Cr. Misc. No. 85248 of 2024. Learned counsel further submits that petitioners have no criminal antecedent as mentioned in para-3 of this application.
5. Learned APP for the State opposes the prayer for bail.
6. Having regard to the facts and circumstances of the case, since there is admitted land dispute between the parties and similarly situated co-accused have been enlarged on bail, let

No.4068 of 2025(2) dt.07-02-2025 3/3 the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Amarpur P.S. Case No.214 of 2024, subject to the condition as laid down under Section 482 (2) of the B.N.S.S, 2023.
