The petitioners seek bail in anticipation of their arrest in connection with Karghar P.S. Case No. 33 of 2020 instituted for the offences under Sections 147, 148, 149, 323, 341, 342, 338, 427, 307, 353, 504 and 506 of the Indian Penal Code.

Patna High Court CR. MISC. No.13741 of 2021(2) dt.03-01-2022 2/3 The petitioners are said to have attacked the police party which had gone to remove the encroachment under the orders of the competent officer. The Circle Officer, who was heading the team, was also misbehaved with.

It has been submitted on behalf of the petitioners that the accusations against them are absolutely general and omnibus. Merely because they were the bystanders, they have been made accused in this case on their names having been supplied by persons who had definite axe to grind against them.

It has further been submitted that under similar circumstances, some of the other accused persons of this case have been granted anticipatory bail by this Court. For the reasons afore-stated, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SubJudge-VII, Sasaram, Rohtas in connection with Karghar P.S.
