JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

Petitioner is named in the First Information Report with general allegation of firing and, according to prosecution case itself, the informant sustained firearm injury at the hands of F.I.R. named accused Tuntun Poddar as well as Vivekanand Chaudhary @ Bauwaji. Learned counsel for the petitioner submits that coaccused Vivekanand Chaudhary @ Bauwaji has already been granted privilege of bail by the learned court below itself and so far as criminal antecedent of the petitioner is concerned, the petitioner has already been acquitted in two cases. It is further contended by him that as a matter of fact, the petitioner had to depose against the informant in a murder case and that is the reason of false implication of the petitioner in the present crime.

No.7375 of 2016 (2) dt.16-02-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, the above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bakhri P.S. Case No. 101/15 corresponding to G.R. No. 1638/2015.
