Ist Class, Vaishali at Hajipur reveals that the case is still pending for appearance of co-accused Md. Sona against whom non-bailable warrant of arrest has already been issued and its service report has not yet been received.

The petitioner has renewed his prayer for bail which was rejected by this Court vide order dated 14.7.2014 passed in Cr. Misc. No. 16078 of 2014 as the petitioner and co-accused both committed rape with the informant and during investigation in the statement recorded under Section 164 Cr.P.C. also she has supported the allegation. The ground for renewal of prayer for bail appears not justifiable accordingly, prayer for bail of the petitioner in connection with Desari P.S. Case No. 47 of 2013 is hereby

Patna High Court Cr.Misc. No.3252 of 2015 (3) dt.11-02-2015 again rejected.

However, the court below is directed to separate the case of the petitioner and commit his case to the court of Sessions at once.
