JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-01-2019 This writ application has been preferred for a direction to the respondent Insurance Company to pay the insurance claim of the petitioner in terms of the report of the Surveyor. The writ application lacks essential details as to the policy in question and the terms and conditions on which while availing loan from the Bank, the Bank is said to have taken the responsibility to pay the insurance premium.
The writ Court is unable to issue any positive direction in the facts and circumstance of the present case. In case the petitioner is aggrieved by inaction or deficiency in service on the part of the Insurance Company in not considering his insurance claim, he may pursue his remedy, if so advised, for the
Patna High Court CWJC No.1435 of 2019(2) dt.28-01-2019 2/2 deficiency in service before an appropriate forum. The writ application is disposed of with the liberty aforesaid to the petitioner.
