Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,323,324,379,307,504/34 of the Indian Penal Code. During occurrence of assault, some of the petitioners are specifically alleged to have caused injury at the head though the Doctor has found simple injury. Patna High Court CR. MISC. No.2402 of 2020(3) dt.18-06-2020 2/2 had knowledge that their act might cause death. Hence, I am not inclined to enlarge the petitioners on anticipatory bail in connection with Basantpur P.S.Case No.346 of 2019 pending in the court of learned Chief Judicial magistrate, Siwan. Prayer is refused. In the event of surrender, prayer of the petitioners for regular bail shall be considered on its own merit without being prejudiced by this order.
