JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have made attempt to commit rape on the informant but due to timely arrival of the police, petitioner was caught and remanded in the present case.
The contention on behalf of the petitioner is that no such occurrence did ever take place, as alleged in the first information report, and, as a matter of fact, petitioner has been implicated in this case with concocted story and, moreover, petitioner is in jail custody since 22.06.2014 and further detention of the petitioner is not warranted in the present case as the petitioner has sufficiently been punished.

Patna High Court Cr.Misc. No.7871 of 2016 (2) dt.19-02-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S.Case No. 104 of 2014.
