JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 11-01-2022 Heard the parties through video conferencing. Learned counsel for the petitioners does not want to press the bail application on behalf of petitioner nos. 1 and 3, namely, Mohan Ram and Saheb Kumar and confining his prayer with respect to petitioner nos. 2, 4 and 5.

The petitioner nos. 2, 4 and 5, seek bail in anticipation of their arrest in connection with Srinagar (Pujaha) P.S. Case No. 78 of 2020 instituted for the offences punishable under Sections 341, 323, 324, 354-B, 379 and 504/34 of the Indian Penal Code.

The submission is that the present case has been registered after a case was registered by the petitioners against the complainant. Considering the overall aspects and the nature of injury, while bail application of petitioner no. 1 and 3 is dismissed as not pressed, I deem it appropriate to allow anticipatory bail of petitioner nos. 2, 4 and 5 namely Malti Devi, Indu Devi and Punam in the event of arrest they shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
