2. The petitioners apprehend their arrest in a case punishable for the offence under Sections 420, 295(A) , 465 , 496 and 504 of the Indian Penal Code .

3 . As per the prosecution case , the complainant started working for providing self-employment to the women through Prime Minister Money Scheme (Pradhan Mantri Mudra Yojana). The complainant came to know that this petitioner during her work introduced herself as Block Authroity InCharge of Pradhan Mantri Mudra Yojana. He assured her that he would provide the services to the applicant/woman at the earliest. The complainant and other women submitted 400-500 forms to the petitioner with a fee of Rs. 300/-, but to date no benefit has been provided to the complainant, and as such, the

4. Learned counsel for the petitioners submits that petitioner is innocent and has committed no ofence . No such occurrence has ever taken place . Learned counsel for the petitioner fairly submits that petitioner is ready to deposit the alleged amount i.e. Rs. 20,000/- (Rupees twenty thousand) in the Nazarat of the concerned Civil Court, for which, learned counsel for the State does not oppose .

5. In view of undertaking given by petitioner that he is ready to deposit the defalcated amount, the prayer for anticipatory bail of petitioner is allowed.

6. Accordingly, let the above named petitioner, in the event of their arrest/surrender within a period of eight weeks from today , be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Darbhanga in connection with Laherisarai P.S. Case No. 701 of 2022 subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further following conditions:

"(A) At the time of furnishing bail-bond, the petitioner shall deposit Rs. 20,000/- ( twenty thousand) in the Nazarat of concerned Civil Court

(b) The aforesaid payment shall be subject to final outcome of the case .

(C) If petitioners fail to comply the direction of this Court, the learned Court below would be at liberty to cancel the bail-bonds of the petitioner."

7. This order has been passed, without going into the merit of the case, only for the purpose of considering the prayer for anticipatory bail of petitioner.
