Petitioners are languishing in custody since 10.07.2013 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The accusation is of committing dacoity. The name of the petitioners sprang up on the confessional statement of co-accused Vijay Sahani.
Learned counsel for the petitioners submits that neither recovery has been made from the possession of the petitioners nor they have been put on T.I.P.
Considering the fact that neither recovery has been made from the possession of the petitioners nor petitioners
Patna High Court Cr.Misc. No.4088 of 2015 (2) dt.30-01-2015 have been put on T.I.P., let the above named petitioners, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra P.S. Case No. 233 of 2012.
Considering the criminal antecedent of the petitioners, the learned court below will cancel the bail bonds of the petitioners, if they substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
