Earlier the prayer for bail of the petitioner was rejected by this Court twice- firstly on 2.5.2017 passed in Cr. Misc. No.18955 of 2017 with observation that the trial may be expedited and secondly order dated 6.12.2017 passed in Cr. Misc. No.55197 of 2017, directing the learned trial court to conclude the trial preferably within a period of one year, however, submission of the learned counsel for the petitioner is that in this case all the other accused persons have been granted bail vide order dated 17.4.2018 passed in Cr. Misc. No.22086 of 2018, order dated 17.10.2016 passed in Cr. Misc. No.33723 of 2016, order dated 16.2.2017 passed in Cr. Misc. No.54088 of 2016 and up till now only two witnesses have been examined and he is in custody for more than two years. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ XIII, Patna in connection with Phulwari Sharif P.S.Case No.46 of 2016 S.T.No.735 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled and further condition that before releasing him on bail, the bailors and their addresses shall be verified. With the aforesaid direction, this application is allowed.
