Petitioner is languishing in custody since 07.10.2014 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

It is alleged that mobile of the informant was robbed by three accused persons. The petitioner was caught on the spot, but two others managed to flee away. It is submitted by the learned counsel for the petitioner that only on suspicion the petitioner was implicated in the present case as there is no recovery from the possession of the petitioner.

Considering the fact that though the petitioner was caught on the spot, but no recovery was made from the

No.3850 of 2015 (2) dt.30-01-2015 possession of the petitioner, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabhua P.S. Case No. 444 of 2014.

Since the petitioner is accused in two other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
