JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-02-2020 On perusal of the allegation made in the first information report, this Court finds that the allegations are that of commission of a cognizable offences and in such circumstance the FIR has been registered and the matter is under investigation, there is no reason for this Court to interfere with
Patna High Court CR. WJC No.55 of 2020(2) dt.05-02-2020 2/2 the investigation at this stage.
Mere lodging of the FIR is not the initiation of a criminal proceeding though the machinery of the criminal law justice has been set in motion but at this stage given the kind of allegations it would not be just and proper for this Court to exercise its power under Article 226 of the Constitution of India. The writ application has no merit, it is dismissed accordingly.
