Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354(B) of the Indian Penal Code and Section 12 of POCSO Act. Allegation against the petitioner is of sexual harassment and physical contact with intent to sexually harass a minor girl, who is informant of this case.

Learned counsel for the petitioner submits that there is delay of few days in lodging of the FIR. The petitioner had also filed an informatory petition before the Sarpanch alleging therein false implication, the parties have entered into a compromise subsequently.

No.1820 of 2020(3) dt.15-06-2020 2/2 Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail in connection with POCSO Case No.90 of 2019 arising out of Belaganj P.S.Case No.319 of 2019 pending in the court of learned Special Judge (POCSO Act), Gaya. Hence, prayer is refused.

In the event of surrender of the petitioner within thirty days, prayer for regular bail shall be considered without being prejudiced by this order.
