====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-09-2021 Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Section 7 of the P.C. Act. The criminal prosecution started on complaint made by one Rakesh Kumar, an agent in the Post Office. The petitioner was posted as Sub Post Master in Nayi Bazar, Sub Post Office, Buxar. Allegation is that the petitioner demanded 10% of the maturity amount as bribe as pre-condition to release the maturity amount. The matter was informed to the SP/CBI. A conversation between the petitioner and the complainant regarding aforesaid demand recorded in the mobile phone was also produced and then on trap Rs.11000/- was recovered from the drawer of the petitioner in presence of the petitioner.

Submission is that the petitioner has sufficiently been punished for the offence alleged. He has also lost his job. Investigation of the case is already complete. Mr. Bipin Kumar Sinha, learned counsel for the CBI opposed the prayer for bail.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Special CBI Case No. 15/2020, arising out of CBI/ACB Patna P.S. Case No. RCO232020A0012 of 2020.

Hence, prayer is refused.

Petitioner may renew prayer for bail if the trial would not conclude within nine months from today.

Let the trial Judge take all steps for early conclusion of the trial.
