The petitioners are apprehending their arrest in connection with Sahjananpur P.S.Case no.38 of 2018 dated 19.6.2018 , registered for offences punishable under Sections 436, 506/34 of the Indian Penal Code.
Allegation against the petitioners is that they have threatened the informant of dire consequences and of setting the house on fire and later on 16.6.2018 they came variously arms and set the house on fire causing damage to the various articles including the foodgrains.
Submission of the learned counsel for the petitioners is that this case has been lodged only to save their skin from the
Patna High Court Cr.Misc. No.2460 of 2019(3) dt.21-02-2019 2/2 earlier case lodged by the petitioner no.1 against the informant and others and the materials collected during the course of the investigation also disclose that no burnt articles has been recovered from the place of occurrence.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna City in connection with Sahjananpur P.S.Case No.38 of 2018 dated 19.6.2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
