The petitioner seeks bail in a case under Sections 376, 379, 341, 34 of the Indian Penal Code.

The petitioner and one Shankar Singh were alleged to have committed rape with the victim in the year 1999. Shankar Singh was granted bail vide order dated 25.02.1993 passed in Cr. Misc. No. 1100/1993. The petitioner moved for anticipatory bail but his anticipatory bail was rejected with a direction that the petitioner should surrender in court within two weeks. The petitioner, instead of surrendering in court, remained absconding since 1993. The police, after investigation, submitted final form but the Superintendent of Police later on found the case true and by the order of the Superintendent of Police, chargesheet was submitted. The petitioner was apprehended on 23.09.2013 and

Patna High Court Cr.Misc. No.9815 of 2015 (6) dt.04-09-2015 2/2 since then he is in jail. The petitioner has already remained in jail for about two years.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Arrah in Arra Harijan Cell P.S. Case No. 14/91.
