1. Heard learned counsel for the petitioner and learned AC to GP-2.
2. The learned counsel appearing on behalf of the State at the outset submits that the writ application is not maintainable at the instance of petitioner. The petitioner neither has locus nor it can be inferred from the pleading made in the writ application that petitioner is aggrieved by the action of the authority except for the fact that it is the contention of the petitioner that the Panchayat Sarkar Bhawan which is to be constructed within the Panchayat for which a decision has been
Patna High Court CWJC No.808 of 2025(2) dt.23-01-2025 2/3 taken should not be constructed at a place where the authorities have decided to construct rather it should be constructed at the headquarter of the Panchayat. It is further submitted that from perusal of Annexure-P/3 to the writ application, it would manifest that a representation was submitted to the District Magistrate, Gaya for considering the issue. It is also submitted that from perusal of the representation filed by the petitioner and other, it would manifest that they are not disputing the Panchayat Sarkar Bhawan is not being constructed within the panchayat rather their contention is that it should be constructed at a particular place within the panchayat.
It is further submitted that the representation records that the place decided by the authorities for constructing the Panchayat Bhawan is about one and half kilometers from Nagawan village. The learned State counsel also relies on an order dated 23.02.2024 passed in CWJC No.3280/2024 (Krishna Deo Kumar Vs.
Patna High Court CWJC No.808 of 2025(2) dt.23-01-2025 3/3 jurisdiction to take a decision in this regard, so far the grievance of the petitioner is concerned, he has already represented before the concerned authorities, including the District Magistrate, Arwal and any direction of this Court would be uncalled for, in the matter." The learned State counsel thus submits that in the present case also the petitioner has already submitted a representation along with the villager before the District Magistrate, Gaya on 24.12.2024, as such, any direction by this Court would be uncalled for.
3. The learned counsel appearing on behalf of the petitioner is not in a position to submit the submission of the learned counsel appearing on behalf of the State.
4. Considering the submission, the Court finds no merit in the writ application.
