JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-03-2019 In this case all the petitioners have been granted anticipatory bail except petitioner No.1 vide order dated 28.1.2019 and case diary was called for with respect to petitioner No.1.

Allegation against petitioner No.1 is of assault by road to the informant, causing injury.

Submission of learned counsel for the petitioner is that the whole allegation appears to be false and concocted and complaint case has been lodged after three months. Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that injury was found to be grievous in nature.

Patna High Court CR. MISC. No.4176 of 2019(5) dt.26-03-2019 2/2 In the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner No.1. He should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application with respect to petitioner No.1 is dismissed.
