The petitioner seeks bail in Basnahi P.S. Case No. 67 of 2018, instituted for the offences under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act. There is specific allegation against petitioner of causing fire-arm injury on the back and on right portion of head of father-in-law of the informant, who was sleeping in veranda, who subsequently died.
Case diary has been received, wherein, post-mortem report is available which support the allegations made in the written report. In the post-mortem report doctor has found injury near chest caused by fire-arm.
Patna High Court CR. MISC. No.3077 of 2019(3) dt.01-04-2019 2/2 Therefore, this court is not inclined to grant bail to petitioner. The prayer for bail is rejected at this stage. The trial court is directed to expedite the trial and make effort to conclude the same as early as possible preferably within a period of nine months from the date of receipt/production of a copy of this order.
The petitioner will be at liberty to renew the prayer for bail after nine months in the event no substantive progress is made in the trial.
