The present Appeal has been filed for grant of anticipatory bail against the order dated 19.12.2024 passed by the learned Exclusive Special Judge (SC & ST), Sadar, Patna in ABP No. 5122 of 2024 which was rejected in connection with Punpun P.S. Case No. 358 of 2024 registered for the offence under sections 126(2), 115(2), 308(3), 308(5), 303(2), 352 of the BNS Act, 2023 and Section 3(1)(Dh), 3(1)(D) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
3. As per the FIR, allegation against the appellant is
Patna High Court CR. APP (SJ) No.267 of 2025(4) dt.12-11-2025 2/3 that he along with the other accused persons has assaulted and abused the son and the informant by taking caste name publicly and demanded Rs. 1,00,000/- as extortion money.
4. Learned counsel for the appellant submits that appellant is innocent and has been falsely implicated in this case. He further submits that informant was no present at the place of occurrence but to make case serious in nature, she has stated that the accused persons took her purse containing driving license, Pan Card and Rs. 20,000/- in the pocket. He further submits that all the injury sustained by the injured are simple in nature. He further submits that petitioner possesses clean antecedent as stated in paragraph no. 3 of the bail petition.
5. Learned S.P.P. opposes the prayer for anticipatory bail.

On perusal of FIR and impugned order dated 19.12.2025, it appears place of occurrence is an open place and petitioner had abused the son of the informant and upon objection accused persons assaulted the son of the informant by iron rod and demanded extortion money of Rs. 1,00,000/- and also snatched the purse of the informant. Considering all aspects of the matter and the materials available on record, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the bail application of the petitioner is hereby rejected.
