2. The petitioner is apprehending his arrest in connection with Bikram P.S. Case No. 96 of 2023 for the offence under Sections 341, 323, 307, 504, 506 and 34 of the I.P.C. and Section 27 of the Arms Act, lodged on 03.03.2023 by the informant, Arvind Kumar.

3. As per the prosecution story, the informant has alleged that the accused persons including this petitioner came on motorcycle and after abusing him, they repeatedly fired and when the villagers gathered and the police was informed, they escaped. The police subsequently recovered empty cartridges from the spot. Accordingly, the FIR.

4. Learned counsel for the petitioner submits that the allegation is of 02.03.2023 whereas the FIR was lodged a day

Patna High Court CR. MISC. No.6222 of 2024(2) dt.20-02-2024 2/2 later. Learned counsel for the petitioner further submits that though there is an allegation of opening of fire, no injury has been recorded.

5. Learned APP opposes the prayer stating that not only the petitioner is in the habit of opening FIR, two other criminal cases are lodged against him as would be evident from the paragraph-3 of the petition.

6. Taking into account the said facts, it would be appropriate that the petitioner surrender and seek bail.
