The petitioners apprehend their arrest in Jehanabad (Kalpa O.P.) P.S. Case No.784/2019 registered for the offence under Section 341, 323, 324, 325, 307, 379 and 504/34 of the Indian Penal Code.
The allegation is that petitioners assaulted the informant and his wife by means of lathi and also snatched tops of gold from left ear of the informant's wife. . Learned Counsel for the petitioners submits that the marpeet took place over grazing the field of informant by the goat of petitioner. Petitioners are quite innocent and falsely implicated in this case. In fact, injuries have been found simple
Patna High Court CR. MISC. No.3136 of 2020(2) dt.28-02-2020 2/2 and opinion has been reserved with regard to injury no 1. It is further submitted that petitioners have no criminal antecedent. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event their arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad (Kalpa O.P.) P.S. Case No.784/2019 on the following conditions: "(1) Petitioners shall cooperate in the tiral and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail-bond shall be cancelled by the Court below.
(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
