The petitioners apprehend their arrest in Paharkatta P.S. Case No.12 of 2015 registered under Section 307 and other Sections of the Indian Penal Code.
The gist of the allegation is that the police arrested a girl along with a boy. The recovered girl was handed over to her parents and the boy was confined in police custody but the boy committed suicide inside the police premises. Thereafter the villagers run amuck set ablaze the police vehicles and also damaged many public properties.
The learned counsel for the petitioners submits that the petitioners are also alleged to be the members of the mob. Similarly situated other accused persons have already been granted anticipatory bail vide order passed in Cr. Misc. No.64683 of 2018, Cr. Misc. No.66402 of 2018 and Cr. Misc. No.47992 of 2019.
Considering the facts that similarly situated many other accused persons who were members of the mob have been granted anticipatory bail by different Benches of this Court, let
Patna High Court Cr.Misc. No.6142 of 2019(2) dt.04-02-2019 3/3 the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Pahar Katta P.S. Case No.12 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
