JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 Petitioner seeks regular bail in connection with Harsiddhi P.S. Case No. 349 of 2019 registered for the offence(s) punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Police on information of sale of liquor by some accused persons, raided the place of occurrence, one person was apprehended and other accused persons were succeeded in fleeing away. On search, 400 liters of spirit was recovered from bush.

Submission of the learned counsel for the petitioner is that F.I.R. itself shows that nothing has been recovered from his possession or from his house. He has no criminal antecedent and is in custody for more than 3 months. Charge-sheet has already been submitted.

Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge IX-cumSpecial Judge, Excise, East Champaran at Motihari, in connection with Harsiddhi P.
