Statement of victim has been recorded under section 164 of the Cr.P.C in which she stated that petitioners and two others coaccused were present at Basa from where she was forcibly taken away by co-accused Binba. So far as petitioners are concerned, no specific overt-act has been attributed against them.

Moreover, co-accused Binba and Gholta Tanti have already been granted privilege of bail by a coordinate bench of this court. Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Amarpur P.S. Case no. 80/2015.
