The petitioners are languishing in custody since 22.11.2014 in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and 138 of N.I. Act.

It is alleged that Rs.3,00,000/- was taken by petitioner no. 2 from the informant as loan which was returned by petitioner no. 1 being wife of petitioner no. 2 through seven cheques but the same got bounced.

It is submitted by learned counsel for the petitioners that there is no proof with regard to the payment to the

Patna High Court Cr.Misc. No.5237 of 2015 (02) dt.09-02-2015 2/2 petitioners.

Considering the nature of accusation and the period under custody, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh-Gaya P.S. Case No. 173 of 2013.
