The petitioner apprehends his arrest in Town P.S. Case No. 274 of 2021, registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. Prosecution case in brief is that this petitioner along with co-accused persons in connivance with each other prepared false and fabricated documents and by impersonating the complainant got the land registered in his name. It is submitted that petitioner is neither vendor nor vendee and he has been falsely implicated in this case simply because he is husband of the co-accused Sonam Kishore who alleged to be the vendee. Petitioner is nowhere involved in the

Patna High Court CR. MISC. No.3388 of 2022(2) dt.26-07-2022 2/2 entire transaction. As a matter of fact, his wife co-accused Sonam herself is victim of cheating and fraud committed by the brokers of the land. Moreover, Sonam Kishore has already been granted bail by this court vide order dated 24.03.2022 passed in Cr. Misc. No. 66085 of 2021. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Motihari, East Champaran in connection with Town P.S. Case No. 274 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
