Petitioner is not named in the first information report but in course of investigation, the name of petitioner surfaced in this case.
Learned Additional Sessions Judge-I, Madhepura has referred several paragraphs of the case copy in the impugned order but from perusal of the case diary, I find that in several paragraphs of the case diary, several witnesses stated that coaccused, Vijay Kumar replaced the sub standard bricks and also returned some amount to victims.
It appears to me that the Learned Additional
Patna High Court Cr.Misc. No.3446 of 2015 (5) dt.29-09-2015 2/2 Sessions Judge-I, Madhepura even did not take pain to go through the relevant paragraphs of case diary. Moreover, co-accused Vijay Kumar has already been admitted to privilege of anticipatory bail by this court whereas; the petitioner is languishing in jail custody since 11-10-2014.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Singheshwar P.S. Case No. 06 of 2011 to the satisfaction of Chief Judicial Magistrate, Madhepura.
