Petitioner was caught in objectionable condition along with some females and males from his flat and accusation against him is that he was running a brothel in his flat but submission on behalf of the petitioner is that flat in question was not handed over to him at the time of alleged occurrence which is evident from perusal of annexure 5 to this petition. It is further submitted by him that, as a matter of fact, Munsi of the concerned apartment was instrumental in providing the aforesaid flat to other accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Rupaspur P.S. Case no. 03/2016.
