The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections363, 366A, 34, 120B of the Indian Penal Code.

Petitioner along with other accused persons are said to have enticed away the niece of the informant for the purpose of marriage of some other place.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the alleged occurrence took place on 30.11.2010 and the case was instituted on 06.12.2010. Earlier, prayer for anticipatory bail of the petitioner was rejected on 28.01.2011 by the learned court below and after lapse of 11 years, petitioner again filed the anticipatory bail before the

Patna High Court CR. MISC. No.3936 of 2023(2) dt.06-04-2023 2/2 learned court below which was dismissed on 02.11.2022. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances of the case and the fact that there is delay in filing the present anticipatory bail application, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Hathauri P.S. Case No. 206 of 2010.
