Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner is in jail custody since 25.11.2014 in a case registered for the offences punishable under Sections 376, 511 of the Indian Penal Code.

At the very outset, it is pointed out by the petitioner that no such occurrence, as alleged in the first information report, did ever take place and as a matter of fact, there was some differences between petitioner and his wife and that was the reason the wife of the petitioner approached the concerned police station and the informant wrote the first information report at the

Patna High Court Cr.Misc. No.4134 of 2015 (2) dt.03-02-2015 dictation of officer in charge of concerned police station. It is further submitted by him that later on, when the real fact came to the notice of informant as well as her mother, they filed compromise petition before the lower court.

Learned counsel appearing for the informant seconded the above stated submissions.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Patna in connection with Budha Colony P.S. Case No. 336 of 2014.
