JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Mansoorchak P.S. Case No. 33 of 2015, registered under Sections 302, 201/34 of the Indian Penal Code. The accusation is that Rohit Kumar, son of the informant was approached by this petitioner to go in his relation. Thereafter, on 19.06.2015 Rohit Kumar moved with the petitioner on motorcycle, but in the evening he did not return. On 20.06.2015, the informant received information that a red colour motorcycle is lying near the house of Vilash Tanti on which blood spot was found. In course of search, informant came to know from the wife of Raju Kumar that Rohit Kumar has died. In the meantime, information was received to the effect

No.9407 of 2016 (3) dt.26-04-2016 2/2 that one dead body has been sent to Sadar Hospital, Begusarai for post-mortem, where informant identified the dead body of his son Rohit Kumar. The informant has suspicion against the petitioner that petitioner murdered his son by means of sharp cutting weapon.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that informant has only suspicion against the petitioner on the basis that the petitioner and his son moved on motorcycle, except that there is nothing on the record to show his involvement in the present case. The petitioner having no criminal antecedent is in custody since 17.08.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.1st, Begusarai in connection with Mansoorchak P.S. Case No. 33 of 2015.
