2. Counsel submits that the petitioner retired from service on 28.02.2017 from Uttar Bihar Gramin Bank, Kanauli Branch, Region Hajipur and was issued with a certificate for his better service in the North Bihar Gramin Bank, now known as Bihar Gramin Bank.

After his retirement, the pension payment order vide PPO No. 3592R20171245 has been issued but, for an allegation of having released the pledged KVP by the customer namely Manoranjan Kumar against the loan A/c No. 1000311510000142, the Pension Payment Order, which is said to have been issued in favour of the petitioner, has been put on hold.

4. It is next submitted that the date on which the pledged KVP is said to have been released by the petitioner, on that day, the petitioner was not posted there and, therefore, the allegation leveled against the petitioner is false and the action of putting on hold the PPO is without jurisdiction.

5. It is the case of the petitioner that for an amount of Rs. 54,000/-, the entire pensionary benefits have been put on hold, is wholly without jurisdiction and disproportionate.

On the other hand, counsel for the Bihar Gramin Bank submits that the allegations, which is incorporated in Annexure-P/5 has not appropriately been answered by the petitioner, owing to which the amount has been put on hold and once such appropriate response is filed, necessary order shall be passed.

Be that as it may, the authorities of the Bihar Gramin Bank is directed to withhold the disputed amount of Rs. 54,000/- and the rest of the amount shall be released within a period of two weeks from today and, with respect to the amount, which is under dispute, appropriate proceedings in terms of Annexure P/5 shall be carried out and necessary order shall be passed and the loan amount of Rs. 54,000/-, which is directed to be withheld till adjudication of the proceedings, the same shall be guided by the nature of the order passed by the authorities in the pending proceedings initiated based on the memo of charge, which is appended with the writ petition as Annexure-P/5.

8. With the aforesaid observation, the writ petition stands disposed of.
