Petitioner is accused in connection with Banka P.S. Case No. 402 of 2014 registered under Sections 147, 148, 149, 435, 427 of the I.P.C., 27 Arms Act, 3⁄4 Explosive Act and section 17 of the C.L.A. Act.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the petitioner is not named in the F.I.R. In course of investigation, name of the petitioner and others had come in the confessional statement of co-accused Ashok Tanti. Except that, there is nothing against the petitioner to show his involvement in the present case. Further submission is that petitioner is apprehended in connection with Bank P.S. Case No.

Patna High Court Cr.Misc. No.9129 of 2016 (2) dt.29-03-2016 2/2 552 of 2015 on 31.08.2015, thereafter, remanded in the present case on 23.09.2015 and also he is accused in three other cases, as detailed in paragraph no.3 of the petition.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Banka in connection with Banka P.S. Case No. 402 of 2014. Out of two sureties, one surety must be parents or close relatives of the petitioner.
