The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code read with section 27 of the Arms Act.

The prosecution case in short is that on the fateful day, when the informant along with his brother was returning from the field, the accused persons, variously armed, fired from the close range which hit the brother of the informant due to

It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.5.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Chargesheet has been submitted in the present case. No injury is inflicted upon the deceased by the petitioner. The main allegation of assault is alleged against Dineshwar Yadav. On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Barh, Patna in connection with Sessions Trial No. 801 of 2019 arising out of Ghoswari (Ghoshwari) P.S. Case No. 20 of 2018.
