The petitioner seeks bail in connection with Bihta P.S. Case No. 395 of 2018 instituted for the offence under Section(s) 30(a) of Bihar Prohibition & Excise Act, 2016. Learned counsel for petitioner has submitted that there is no recovery from conscious possession of this petitioner. The seizure list does not bear signature of this petitioner. In the written report, there is allegation that informant received information that this petitioner and other accused persons are preparing illicit liquor in the middle of Sone river at Taregna Toke.

Petitioner is in custody since 03.12.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act), Patna in connection with Special Case no. 3745 of 2018 arising out of Bihta P.S. Case No. 395 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner.
